These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
Entry and claim instructions are deemed to form part of the terms and conditions and by participating all entrants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

Eligibility
1. The promotion is open to residents of the United Kingdom (excluding Isle of Man and Channel Islands) who are aged 18+, excluding employees and their families of Essity, subsidiary companies, their agencies and anyone professionally connected with this promotion.
2. No purchase necessary.
3. Internet access and a public Instagram or Facebook account required. Participants who do not have an Instagram or Facebook account, are required to create one in order to participate. An active email address is required to do this. Please see relevant webpage on Instagram or Facebook for more details.
4. The entrant entering the promotion must be the owner of the Instagram or Facebook account used. Proof of ownership of the social media account and proof of age may be required.
5. Any entries received from private accounts on Instagram or Facebook will not be entered due to privacy restrictions. To enter from a private account, participants must amend their account settings to a public account in order for their entry to be accepted. The account must remain public during the promotion and for 4 weeks after the end of the promotion to enable the Promoter to contact the entrant in the event of their entry being a winner.
6. There is a maximum of one (1) prize per person during the full promotional period.
7. Maximum one (1) entry per person, per week during the promotional period, regardless of the number of Instagram or Facebook comments made during the promotional period.
8. Entries (bulk or otherwise) made from consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using alternative details or a computer(s) to circumvent this condition by, for example, creating multiple Instagram or Twitter accounts, the use of programme, application, script, brute force or any other automated means, then that person’s entries will be disqualified, and any prize awarded will be void.
Promotional Period
9. The prize draw period opens at 00:00 on 25th September 2023 and closes at 23:59 on 28th October 2023. Any entries received outside of these times and dates or deemed not to be a suitable standard as detailed in the “content”, will not be included in the prize draw and will not have a chance to win a prize.
Entry Requirements
10. To enter the prize draw for the chance to win an official Rugby World Cup shirt & Tena Men bundle, participants must during the promotional period:
a. Like the promotional post on Instagram or Facebook
b. Follow @TENA_men on Instagram or /tenamenuk on Facebook
c. Comment on the post with your favourite national rugby team from England, Wales, Scotland or Ireland.
11. Entrants who do not give the correct details or those who make and entry on someone else’s behalf will be disqualified.
12. Numerous factors outside the control of the Promoter may interfere with the operation of Instagram and/or Facebook. The Promoter does not therefore guarantee continuous, uninterrupted or secure access to either platform.
13. Incomplete, illegible or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
14. The Promoter monitors responses to this Promotion and if any responses or any previous posts made by an entrant are or could be regarded as being disrespectful towards other members of the Instagram or Facebook community, or which contain anything which is likely to, or could cause offence or distress will be removed from the Promotion. 15. Moderation: By participating, entrants understand and agree to their comments for this promotion being publicly displayed. Such entries may be attributed to the original entrant using their name as provided with their entry or as shown on their account. Entries will be strictly monitored by the Promoter. The Promoter and their agents reserve the right to reject any entries for any reason in their sole discretion and the Promoter will reject entries which, in the reasonable opinion of the Promoter:
a. Contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner;
b. Contains any images;
c. Includes trademarks, logos, or copyrighted material not owned by the entrant or used without the right holder’s prior written permission (including famous names, company names, etc.);
d. Defames, misrepresents, or contains content for the intended purpose of harassing, threatening or embarrassing individuals or multiple individuals or insults other people or companies, including, but not limited to the Promoter (including its partners);
e. Promotes any political, blasphemous or religious agenda or any image deemed to incite religious hatred;
f. Is deemed to be distasteful, degrading or will in any way cause offence:
g. Any Facebook or Instagram name or profile photograph which contravenes the above will be void, and any entries will not count;
h. Any entry that contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files.
i. Contains content deemed socially irresponsible or likely to breach the CAP code.
16. Comments must not mention or tag another person. All entries must conform to Instagram & Facebook guidelines and their associated terms and conditions of use.
17. The Promoter and their agents reserve the right, but not the obligation, to monitor and review the content submitted, and to remove or refuse to take forward as an entry any content submitted that the Promoter does not deem, in its sole discretion, to be appropriate, or which the Promoter deems to violate any of these Terms and Conditions.
18. All entries will be strictly monitored by the Promoter and their third-party adjudicators throughout and any attempts to manipulate or otherwise unfairly influence the prize draw will result in disqualification of entry or suspension of the promotion.
19. The Promoter reserves the right to report any content violations to the appropriate authorities.
20. The Promoter does not guarantee that you will have any recourse to edit or delete any comment you have submitted. You acknowledge that you, not the Promoter, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of the Promoter, its agents, subsidiaries, affiliates, or third-party service providers and their respective directors, officers and employees. The person who uploaded the comment is the individual who is entered into the prize draw and the entrant confirms that they have obtained any and all releases and consents if relevant of third parties necessary to permit the submission for the purposes of this prize draw in the manner set forth in these Terms and Conditions without additional compensation.
Prizes & Fulfilment
21. The prize consists of a signed official Rugby World Cup shirt for England, Wales or Scotland OR an official Rugby World Cup shirt for Ireland, & Tena Men bundle (includes Washable Pants, Keep Control Socks, pen & Level 2 Pads).
22. There is a total of four (4) prizes available to be won as follows:
a. 1 x signed official England Rugby World Cup shirt & 1 x Tena Men bundle
b. 1 x signed official Wales Rugby World Cup shirt & 1 x Tena Men bundle
c. 1 x signed official Scotland Rugby World Cup shirt & 1 x Tena Men bundle
d. 1 x official Ireland Rugby World Cup shirt & 1 x Tena Men bundle
Winners will be drawn based on the favourite team selected by entrants when entering the promotion.
23. The prizes will be sent to winners via post; therefore it is the winners’ responsibility to provide complete and accurate postal addresses in order for the Promoter to complete all prize fulfilment. Winners should allow up to 28 days to receive their prize from date of valid claim and the completion of any verification process.
24. All prizes are non-transferrable, non-negotiable and non-refundable. No cash alternative is offered in whole or in part and the Promoter reserves the right to substitute any part of the prizes for an item of equal or greater value due to circumstances outside of the Promoter's control should any element of the prize be unavailable. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winners.
Winner Selection & Notification
25. Winners will be chosen via an independently verified random computer programme on 30th October 2023 from all valid entries received. A winner will be redrawn if they have previously won. Winners will be notified on Instagram or Facebook (whichever platform they entered on) via a direct message from the Promoter. within 3 working days of the prize draw taking place and will be required to respond to confirm eligibility including proof of age and provide information, such as postal address and mobile number for the fulfilment of the prizes. County of residence will be requested for the purpose of the winners list if no objection is received. All winners must claim their prize within 14 days of first notification. If a winner rejects the prize, fails to pass verification or to claim their prize within 14 days, the Promotor reserves the right to forfeit the prize from this person and contact reserve winners drawn next in line in the original draw to fulfil any prizes not claimed in this manner. The process will repeat until an eligible winner is able to claim the prize. Entrants are encouraged to monitor their social media account(s) during this time in case they are a winner.
General
26. The Promoter shall have sole and final determination as to which entries are genuine and therefore eligible to take part in this promotion. The Promoter’s decision is final and binding with regard to all promotional matters and will not respond to any correspondence.
27. It is the responsibility of each winner to provide correct, up-to-date on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or fulfilment of their prize.
28. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.
29. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
a. Any faulty, incorrect, erroneous or failed electronic data transmissions;
b. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
c. Inaccessibility or unavailability of the internet or social media platforms or any combination thereof;
30. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
31. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
32. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address and identity (passport, driving licence or equivalent), which they must provide within 7 calendar days and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
33. By taking part in the promotion the prize winners agree that the Promoter may contact them to ask whether they want to participate in marketing activities relating to the promotion.
34. Subject to the Promoter’s Privacy Policy, the winners’ surnames and counties of residence will be available by sending an email request to TENA@zealcreative.com with ‘WINNERS LIST: Tena Men Social Promotion’ in the subject line, for a period of 3 months following the end of the promotion period. When contacting this email address, your request will be actioned in line with Essity’s Privacy Policy and the Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing TENA@zealcreative.com The Promoter nevertheless will disclose the information to the Advertising Standards Authority if required to do so.
35. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using a prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
36. This promotion is in no way sponsored, endorsed, or administered by, or associated with Instagram or Facebook. The entrant accepts/understands that they are providing their information to the Promoter, and that Instagram or Facebook has no liability for any element of this promotion.
37. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
38. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.
Data Protection
39. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 34 above and winners can object to this by emailing TENA@zealcreative.com Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable.
